Sweepstakes Rules

The Sweepstakes is open to legal residents of the United States who are twenty-one (21) years or older at the time of entry. Void where prohibited by law. 

No purchase necessary to enter or win. A purchase does not increase your chances of winning. 

Employees, temporary employees, independent contractors and interns of participating locations, Elite Rewards and each of their respective subsidiaries, parents, partners, advertising and promotional agencies and the immediate family members of each, and any persons living with, any such employees are not eligible to enter or win prizes. The term “immediate family members” includes spouses, parents, grandparents, siblings, children, and grandchildren.

ODDS OF WINNING: Odds of winning depend on the number of eligible entries received. 

PRIZE OPTIONS:

• Venice to Athens 8 day, 6 tours, 4 countries  

Travel is from the closest major airport in relation to the winner's place of residence. Winner is responsible for all expenses not expressly provided for the above on the package pdf previously provided (refer to Exhibit A), including souvenirs, entertainment, incidentals, tips, parking, ground transportation, telephone calls, or other personal expenses incurred during or in connection with the trip. Winner's travel companion must be a legal US resident and must travel with the Winner. Prize winner's companion must also be age 21 or older. 

Prize is non-transferable and may not be redeemed for cash; substitutions may not be requested. By participating in the Sweepstakes and accepting a prize, participants and winner will be deemed to agree to these Rules. Winner is responsible for all applicable federal, state, and local income and any other taxes, fees and surcharges. An IRS Form 1099 is required for all prizes with a retail value in excess of $600. Sponsors reserve the right to substitute a prize of equal or greater value. 

WINNER SELECTION: Winner will be selected by a random drawing from all qualified entries received by the Deadline. Winner will be notified by phone on or near the date specified. If a winner is unreachable after two (2) business days, an alternate winner will be selected by a random drawing from the remaining qualified entries. In order to be named a winner, potential winner may be required to execute and return an Affidavit of Eligibility/Prize Acceptance Form/Release of liability upon accepting a prize. Noncompliance will result in disqualification and an alternate winner will be selected. 

USE OF SWEEPSTAKES INFORMATION: Notwithstanding any contrary provision in any Sponsor's respective privacy policies, Participants grant to Sponsors, and Sponsors reserve, the right to use any and all information related to the Sweepstakes, including information provided by Participants in connection with the Sweepstakes, for marketing purposes or any other purpose, unless prohibited by law. Participants may be required to sign a release, which grants to Sponsors the right to use and publish their proper name and state of residence online or in any other media in connection with the Sweepstakes. By accepting a prize, winner(s) may be required to sign a release that grants permission to Sponsors to use his or her name, photograph, likeness, voice, prize information and/or biographical information for publicity and promotional purposes without future compensation unless prohibited by law. By receipt of any prize, winner agrees to release and hold harmless Sponsors, and each of their respective parents, subsidiaries, affiliates, directors, officers, employees and agents (collectively, the "Released Parties") from and against any claim or cause of action, including, but not limited to, personal injury, death, or damage to or loss of property, arising out of participation in the Sweepstakes or receipt or use or misuse of any prize. 

CONDUCT: By entering the Sweepstakes, you agree to be bound by these Official Rules. Sponsors reserve the right at their sole discretion to disqualify any individual they find to be tampering with the entry process; or to be acting in violation of the Official Rules. You agree that in your participation in the Sweepstakes you will not use obscene, libelous or slanderous language, or language that infringes upon a third party's trademark, trade name or other intellectual property right or right of privacy. You agree to indemnify and hold harmless Sponsors and each of their respective subsidiaries, parents, partners, or other Sweepstakes sponsors, officers, consultants, agents, and employees against and from all claims, damages liabilities, costs and expenses asserted by third parties alleging that the Sweepstakes includes obscenity, libel, slander, or infringes upon the third party's intellectual property or privacy rights, as a direct result of your actions in connection with the Sweepstakes. You further agree to not knowingly damage or cause interruption of the Sweepstakes or to prevent others' participation in the Sweepstakes. CAUTION: ANY ATTEMPT BY A PARTICIPANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES IS A VIOLATION OF CRIMINAL AND CIVIL LAWS, AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSORS RESERVE THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PARTICIPANT TO THE FULLEST EXTENT PERMITTED BY LAW. 

LIMITATIONS OF LIABILITY: Winners assume liability for losses or injuries caused or claimed to be caused by participating in the Sweepstakes, or by the acceptance, possession, use of, or failure to receive any prize. The Released Parties are not responsible for (i) any incorrect or inaccurate information, whether caused by entrants, printing errors or by any of the equipment or programming associated with or utilized in the Sweepstakes; (ii) any lost, late, illegible, or incomplete entries; or (iii) for any technical or human error that may occur in the processing of submissions in the Sweepstakes. Sponsors assume no responsibility for an error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction of authorized access to, or alteration of, entries. Sponsors are not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers or providers, computer equipment, software, failure of email or players on account of technical problems or traffic congestion on the Internet or at any Web site or combination thereof, including injury or damage to participants or to any other person's computer related to or resulting from participating or downloading materials in the Sweepstakes. If the Sweepstakes is not capable of running as planned for any reason, including legal restrictions, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of Sponsors that corrupt or affect the administration, security, fairness, integrity or proper conduct of the Sweepstakes, Sponsor reserve the right to cancel, modify or suspend the Sweepstakes. 

INTELLECTUAL PROPERTY: The Sweepstakes and all of the related pages, contents and code are copyright Elite Rewards or their sponsors. Copying or unauthorized use of any copyrighted material or trademarks without the express written consent of its owner is strictly prohibited. 

GENERAL CONDITIONS: This Sweepstakes is subject to all federal, state, and local laws and regulations and is void where prohibited by law.
